Customers submitting an order agree to be bound by the following terms and conditions set out by Tim WAW Pty Ltd trading as abi and joseph (the “Company”). The following terms and conditions supersede any previous terms and conditions and the Company reserves the right to make changes to the websites and this document at anytime.

1.         LIABILITY

1.1.      The Company does not accept liability for any loss or damages caused by this website, or any website linked to this website.

1.2.      The Company Reserves the right to refuse or cancel an order at anytime without giving reason. We will make all reasonable effort to contact the customer using the details provided and all received monies will be refunded using the method received.

 

2.         ORDERING METHOD

2.1.      The Company’s websites (including www.abiandjoseph.com and www.abiandjoseph.com.au and other domain names operated by ABI AND JOSEPH ONLINE PTY LTD) offer on-line purchasing. Orders via phone, fax or email can also be accepted but are always subject to final confirmation of the Company’s management and may be cancelled at anytime.

 

3.         CURRENCY USED

3.1.      On the Company’s websites (www.abiandjoseph.com) the nominated currency used for all transactions is US Dollars (USD$).

3.2.      All prices displayed on this website will be in USD$ and will not  be inclusive of any taxes.

  

4.         SHIPPING RATES

4.1.      The Company will publish or display the current shipping rates on the websites as applicable.

4.2.      Shipping rates may vary and the free or fully discounted shipping may cease at any time at the discretion of the Company.

4.3.      The Company reserves the right to change any or all of the following, at any time:

4.3.1.   Shipping rates charged to any destination;

4.3.2.   Delivery method;

4.3.3.   Carrier or shipping provider.

 

5.         SHIPPING to USA and International

5.1.      Online orders for delivery are normally dispatched via DHL, are trackable, and usually arrive within 5 to 12 working days from dispatch to USA, Western Europe, and Asia, 3-5 days to New Zealand and 8-14 days for the rest of the world.

5.2.      Standard Shipping rates for delivery are freight free of charge for all orders over $100 USD and $9.90 USD for all orders under $100USD.

5.3.      The Company does not accept any responsibility for customs delays, duties or taxes that may apply; these will solely be the responsibility of the purchaser.

 

6.         INTERNATIONAL SHIPPING

6.1.      The Company ships to most destinations around the world via DHL.

6.2.      Orders should normally arrive within 5-14 working days from dispatch.

6.3.      The Company does not accept any responsibility for customs delays, duties or taxes that may apply in the destination country.

6.4.      International customers (customers outside Australia) will need to check with their local customs office in regard to what, if any, duty you may be liable for when the order arrives.

7.         DISPATCH OF ORDERS

7.1.      Orders are normally dispatched within 1-2 business days of Order Confirmation subject to all ordered items being in stock.

7.2.      If any items cannot be fulfilled from your order the items will be deducted from your order prior to sending and your invoice adjusted accordingly.

 

8.       ACCEPTANCE OF GOODS

8.1.    On receiving the order the customer is responsible for inspecting the goods for fault or damage.

8.2.    Should the items ordered not be of acceptable quality, it is the customer’s responsibility to notify the Company, as soon as possible. Please see Returns Policy for more information.

 

9.       PRICING

9.1.    The Company reserves the right to change prices without notice.

9.2.    All prices and orders are displayed and processed in US Dollars (USD) and will not include taxes.

9.3.    Customers having orders delivered outside Australia are exporting the goods and therefore shall not subject to Australian Taxes.

 

10.       GIFT CARDS

10.1.    The Company may from time to time make Gift Cards available on the website.

10.2.    Gift Cards when issued may be used online via the the Company websites in the country of issue.

10.3.    Gift Cards are treated by the Company as a financial instrument for payment for goods and services and operate on a deposit/withdrawal system as per industry standard practices. This means that the Company Gift Cards are provided as a free service to customers and do not constitute a purchase of goods and do not contribute toward the calculation of shipping costs or discounts.

10.4.    The Company Gift Cards are not considered as goods or services with a retail price and therefore:

10.4.1. They do not include any applicable sales taxes;

10.4.2. They cannot be discounted and are not subject to any discounts.

 

11.       RETURNS OR EXCHANGES

11.1.    We understand selecting the right style and size online can be a difficult one. For this reason, we welcome an exchange, credit note or full refund on online orders within 28 days of purchase provided the tax invoice can be produced, the original tags are attached and items are returned in unworn condition in line with our returns policy.

13.2.    All returns must be received at the address 10/231 Holt Street, Eagle Farm QLD 4009 within 28 days of receipt of order. All returns received outside this 28 day period are unable to be processed and will be returned to sender.

13.3    Garments where the swing tags have been removed are unable to be accepted for return due to hygiene reasons. No Exceptions. These garments are unable to be resold for hygiene purposes and will be returned to sender.

13.4.    Refer to our Returns Policy which forms part of these terms and condition and which can be amended at any time without notice.

 

12.       RETURN OF GIFT WITH PURCHASE OR PROMOTIONAL ITEMS

12.1.    If your order is returned for refund and you have received a promotional item of gift with purchase, the item must also be returned in original condition; otherwise the retail price will be deducted from the refunded amount.

12.2.    If you wish to return purchased items but keep the promotional item we are happy to offer you an online credit note.

12.3.    There is no warranty or exchange on gift with purchase items and/or promotional products.

 

13.       ORDER CANCELLATIONS

13.1.    Orders may be cancelled only in the instance where the order has not yet reached the packing stage.

 

14.       TYPOGRAPHICAL ERRORS

14.1.    In the event that an item is listed at an incorrect price or with incorrect information, The Company reserves the right to withdraw an item from sale, and to refuse or cancel orders.

14.2.    The Company will make all reasonable effort to contact the customer using the details provided and all received monies will be refunded using the method received. This means that the credit card used to purchase the goods would be the destination of any credit that may be applicable.

 

15.       ARTICLES AND INFORMATION

The Company does not take any responsibility for information provided through its website including but not limited to the following forms: blogs, articles, information releases, recipes, training programs, media releases, topics of interest and it is up to individuals to assess the suitability of the information provided to their own individual circumstances.
